Please be sure to read this document mindfully before you purchase any product or service from us and if you have any questions please be sure to ask us prior to agreeing to these terms. 

These Terms & Conditions of Use (this “Agreement“) apply to all of the products, services and websites offered by SCOLIOLISTIK - Léa Maison, both online and in person
(1) Private classes and coaching programs online or in-person
(2) Group classes and meetings online or in-person (such as webinars, workshops, discussion groups and other group gatherings of any sort)
(3) All digital content such as: exercise libraries, online courses and programs, ebooks, gift cards
(4) Any service or product whether one-time purchase, recurring payments/subscriptions or free, provided by SCOLIOLISTIK and its owner Léa Maison

GENERAL

1. Visitor, client, student and member agreement
When viewing or using this site as a “Visitor” or purchase a product or service from us you agree to all the terms and conditions of this agreement.

You agree that the information contained in this agreement outlines a complete agreement between you and SCOLIOLISTIK - Léa Maison

If any part of this agreement becomes invalid or discontinued you agree that the remaining parts will continue to be valid.

2. Health Disclaimer
SCOLIOLISTIK - Léa Maison is not a medical organisation and its teachers cannot give you medical advice or diagnosis. All suggestions and comments relating to the use of equipment, poses, movements and instruction are not required to be performed by you and are carried out at your election while viewing SCOLIOLISTIK - Léa Maison’s videos/classes. Nothing contained in the Service should be construed as any form of such medical advice or diagnosis.

You are urged and advised to seek the advice of your doctor or treating practitioner before beginning any physical exercise regimen, routine, program, or using any suggested equipment shown in any of the video clips on the Service.

By using the Service, you represent that you understand that physical exercise such as yoga carries the risk of injury whether physical or mental. You understand that it is your responsibility to judge your physical and mental capabilities for such activities. It is your responsibility to ensure that by participating in classes, immersives, courses, programs and activities from SCOLIOLISTIK - Léa Maison, you will not exceed your limits while performing such activity, and you will select the appropriate level of activity for your skills and abilities, as well as for any mental or physical conditions and/or limitations you have. You understand that, from time to time, teachers may suggest physical adjustments or use of equipment and it is your sole responsibility to determine if any such suggested adjustment or equipment is appropriate for your level of ability and physical and mental condition.​​

3. Release of Liability
By agreeing to these terms, you recognise there are certain inherent risks as outlined above associated in performing the movements and poses as instructed in the Service and you assume full responsibility for personal injury to yourself and (if applicable) your family members, and further release and discharge SCOLIOLISTIK - Léa Maison for injury, loss or damage arising out of your or your family’s use of the Service, whether caused by the fault of yourself or of your family.

You agree that practising with us involves a risk of minor and major injury, soft tissue injury, broken bones and joint injuries and that you practise using the instruction provided in the Service at your own risk.

4. Proprietary Rights
Materials on the Service, including, without limitation, names, logos, trademarks, images, text, graphics, videos, photographs, illustrations, artwork, software and other elements (individually and collectively, “Material”, “Content”) are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by SCOLIOLISTIK - Léa Maison or by third parties that have licensed or otherwise provided their material to SCOLIOLISTIK - Léa Maison. You acknowledge and agree that all Materials on the Service are made available to you for limited, non-commercial, personal use only. Except as specifically provided herein or elsewhere on this Service, no Material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without SCOLIOLISTIK - Léa Maison’s prior express written permission. You may not add, delete, distort, or otherwise modify the Material. Any unauthorised attempt to modify any Material, to defeat or circumvent any security features or to utilise the Service or any part of the material for any purpose other than its intended purposes is strictly prohibited.

SCOLIOLISTIK - Léa Maison reserves the right to replace or remove any Content and the platforms available to you through the Service, including specific titles of Content, and to otherwise make changes in how we operate the Service. Additionally, you agree that for various reasons, certain Content may be available through one platform may not be available on another. We hope not to, but we may change, suspend or discontinue – temporarily or permanently – some or all of the Service (including the Content and compatible devices through with the Service is accessed, with respect to any or all users, at any time without notice. In our continued assessment of the Service, we may from time to time, with respect to any or all of our users, experiment with or otherwise offer certain features or other elements of the Service, including promotional features, user interfaces, plans, pricing, and advertisements. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.

These terms and conditions (Subscriber Terms) govern your use of the subscription and other paid services (Paid Services) offered by SCOLIOLISTIK - Léa Maison

These Subscriber Terms apply in addition to the SCOLIOLISTIK - Léa Maison website terms which govern your use of the SCOLIOLISTIK - Léa Maison’s website.

We reserve the right to revise and update these Subscriber Terms at any time. Any amendments to the Subscriber Terms takes effect on the first renewal of your Subscription or applicable Paid Service, and for any new Subscriptions or Paid Services, after the revised Subscriber Terms are posted on the Website.

You must be at least 18 years old to use a Subscription or other Paid Services.

GENERAL

  1. Definitions:
    Paid Services means any paid services offered by us or our Affiliates, online or in person.
    Subscription means a subscription to use Paid Services.
    Subscription Access means access to the Subscription Only Areas.
    Subscription Content means the content in the Subscription Only Areas.
    Subscription Only Areas means the subscription only areas of the Website and any other platform.
    User Account and User Account Details have the meaning given in the Website Terms.
    Website means www.scoliolistik.com
    Website Terms means the SCOLIOLISTIK - Léa Maison website terms.​

SUBSCRIPTIONS AND PAID SERVICES

  1. When you enter into a Subscription with us, you will be granted access to the Subscription Only Areas of the Website (Subscription Access) for the term of your Subscription, subject to these Subscriber Terms and the Website Terms.

  2. Subscriptions (either monthly, trimestrial,  semestrial or annual) will continue until terminated in accordance with these Subscription Terms. You may terminate a subscription any time through your User Account. To learn how to terminate your monthly subscription, please contact us on lea.maison@gmail.com. Any such termination will take effect at the end of the current monthly/trimestrial/semestrial or annual period.

  3. Your Subscription Access constitutes a non-exclusive, non-transferable, limited right to access, use and display on your personal devices the content published in the Subscription Only Areas.

  4. The Subscription Content is for your personal, non-commercial use only. You may not assign, transfer or sublicense any of these rights or publish, share, any Subscription Content to any other person or third party or modify any Subscription Content, or attempt to do any of these things. If you fail to comply with the restrictions in this clause, we may cancel or terminate your Subscription without prior notice or liability to you.

  5. Coach Support and Training Programs: Your Subscription Access may include access to interactions with the coaching team. Whilst we take reasonable steps and precautions to make sure the advice given is accurate, SCOLIOLISTIK - Léa Maison does not make any claims relating to the qualification of our coaches. Your access to Coach Support and Training Programs are subject to the following limitations:

          1. Coach Support and Training Programs are not intended to constitute medical or nutritional advice and are not a substitute for professional              advice, diagnosis or treatment of any disease or condition. You should consult your physician or other health care professional before starting any nutrition and/or fitness program to determine if it is appropriate for you.

          2. Persons subject to a medical or health condition, pregnant women or who suffer from a disability or impairment are strongly urged to seek professional medical advice prior to commencing any form of exercise, training or nutritional program.

          3. You must provide true and accurate information regarding your health and ability to undertake any training, exercise or program. We may refuse to provide access to Coach Support, Training Programs or other similar services if we or one of our coaches believe that training or exercise may pose a risk or hazard to your health or safety, or that you have provided inaccurate or incomplete information regarding your health or ability to undertake training or exercise.

          4. By using the Coach Support and/or Training Programs you warrant and represent that you are able to undertake them safely and are not subject to any medical or other condition which may affect your ability to undertake them, or any part of them, safely, or have been approved by a properly qualified medical professional to do so despite that condition.

   6. Our Subscriptions and Paid Services, including Coach Support and Training Programs are not intended for persons under 18 years of age. If you are under 18 years old, you must not use the Website or any of our Paid Services. By continuing to use the Subscriptions and Paid Services after the Renewal Date, you agree to their renewal.

   7. Free Trials : When taking part in any of the SCOLIOLISTIK - Léa Maison free trials, you will be asked to provide your payment details in advance, this is so that if you decide to continue with your trial your service can continue without interruption. Your card details are securely stored by our payment gateway Stripe which uses industry leading security. We at SCOLIOLISTIK - Léa Maison do not have access to your payment details neither do any individuals. It is your responsibility to cancel your account if you do not wish to continue with your trial which you can do from within your account area. We DO NOT OFFER REFUNDS if you sign up for a free trial and do not cancel your membership within the free trial period.

   8. When you enter into a Subscription with us or purchase any paid service from us, you will automatically be added to a mailing list. If you do not wish to be added to this mailing list, please notify us before purchasing the service or entering the subscription, or send an email to lea.scoliolistik@gmail.com to be removed from the mailing list.​

GENERAL AVAILABILITY OF SERVICES

  1. The availability of our services, including (without limitation) the Website, Subscription Content, Subscription Only-Areas, Coach Support and Training Programs, may be limited based on demographic, geographic, health or other criteria we from time to time determine. You agree and acknowledge that we may terminate your Subscription and/or Paid Services, at any time based on these criteria. In the event of such termination, we will refund any applicable fees and charges for the remaining term of your Subscription or other Paid Services.

  2. Coach Support, Training Programs, and other services involving access to our coaches or other interactive access or communication are subject to coach availability.

  3. You agree and acknowledge that interruptions may occur to our services, including (without limitation) the Website, Subscription Content, Subscription Only-Areas, Coach Support and Training Programs, from time to time, whether or not due to matters within our control. You agree that we are not responsible and have no liability for any temporary or other interruption to our services, whether or not due to matters within our control.

​PRICING AND PAYMENT

  1. No refund or exchange except as required by law: Subject to any statutory or other rights which cannot by law be excluded or limited, and except as otherwise expressly set out in these Subscriber Terms, all fees and charges, including purchases for digital downloads and subscriptions from the Website are non-refundable and non-exchangeable.

  1. Pricing: By purchasing a Subscription or other Paid Services, you agree to pay the price for that Subscription or those Paid Services specified by us at the time of ordering (Price).

  2. Changes in pricing: We may increase or vary the fees and charges for Subscriptions or Paid Services, or institute new fees or charges, at any time in our sole and absolute discretion by publishing them on the Website or by such other means we consider appropriate. Any increase in charges or fees, or new charges or fees, will take effect from the date of your next renewal or purchase of the Subscription or Paid Services to which those charges or fees apply, provided that in the case of automatic renewal, we have given you 7 days’ written notice of the change.

  3. Currency and GST: Pricing and currency may vary depending on the location from which our Paid Services are purchased and may be subject to local taxes and charges.

  4. Payment:

    1. All payments to us are processed by a third party payment processing provider (Third Party Payment Service). By purchasing a Subscription or other Paid Services, you agree to be bound by any terms and conditions of that Third Party Payment Service in addition to these Subscriber Terms. The Third Party Payment Service or your bank or other financial institution may require you to pay processing fees or other fees and charges. Any such fees and charges are your sole responsibility and are not included in the price of your Subscription or other Paid Services unless otherwise specified. We accept no responsibility for your use of any Third Party Payment Service. Our third party payment service is Stripe.

    2. Except in the case of recurring services (such as a monthly subscription), payment must be made at the time of purchasing your Subscription or other Paid Services. In the case of recurring services, you will be charged on a recurring basis at the commencement of each monthly (or other specified) period.

 

   5. Keeping your information up to date: You agree to keep your account and other information including your email address and payment details up to date so that we can process payment, complete your purchase(s), and contact you as needed in connection with your purchases or account.

   6. Incidental charges and expenses: In addition to any fees or charges payable to us, you agree that you remain responsible for all charges, fees or expenses associated with signing up for, using and connecting to the Subscriptions and other Paid Services, including (without limitation) travel costs, telephone or internet access and charges, computer or other equipment.

   7. Termination for incorrect or invalid payment details: If your your payment is declined or fails for any reason, we may cancel your Subscription or Paid Services immediately without prior notice to you.
